Chapter 191 – the 9th Circuit Reverses Dismissal of my Malpractice and RICO Claims

In 2018 I filed a malpractice claim against several Oregon attorneys and an Oregon RICO claim against the Oregon State Professional Liability Fund. To my amazement then, Federal Judge Michael Mosman ordered the case transferred to the US District Court of Oregon where he summarily dismissed all my claims. I believe he did that because I sued court reporter Nancy Walker for editing the transcript.

The 9th Circuit ruled that once Judge Mosman dismissed the claim against Walker, the USDCOR lost jurisdiction. That was what I argued and the 9th agreed.

What’s particularly sad about this experience is that the Oregon State Bar PLF and the attorneys representing the attorneys sued in the action actually argued the court had jurisdiction. This was such a preposterous position that it raises a question as to why? Why would the PLF and the attorneys it controls take a position they must have known would be defeated at a jurisdiction level? What did they have to gain? Why did they try to get away with it?

I remained convinced that the Oregon State Bar PLF is an organization that compromises the civil rights of Oregon Citizens and must be dissolved.
